Terms of Service

These Terms of Service (“Terms”) govern access to and use of RestaurantMart’s QR-based ordering platform (the “Service”). By creating a restaurant account or otherwise using the Service, you agree to these Terms on behalf of yourself and, if applicable, the restaurant you represent.
1. The Service
RestaurantMart provides software that lets guests scan a table QR code to browse a menu and place an order, and lets restaurant staff manage menus, tables, live orders, reviews, and notifications. We may add, change, or remove features over time.
2. Accounts
Restaurant and staff accounts are responsible for keeping login credentials confidential and for all activity under their account. Notify us promptly at the contact below if you suspect unauthorized access. We may suspend or terminate an account for activity that violates these Terms or that we reasonably believe is fraudulent or harmful to the Service or other users.
3. Acceptable use
- Don’t use the Service to publish false, misleading, or unlawful menu, ad, or review content.
- Don’t attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or other restaurants’ data.
- Don’t use guest data collected through the Service for purposes unrelated to serving that guest’s visit.
4. Guest ordering
Guests use the ordering flow without creating an account. The restaurant, not RestaurantMart, is responsible for fulfilling orders placed through the Service, for the accuracy of its menu and pricing, and for handling payment, billing, and any consumer complaints arising from an order. RestaurantMart provides the technology that connects the guest’s order to the restaurant’s kitchen and staff.
5. Subscription & billing
Paid plans, billing cycles, and cancellation terms will be set out at sign-up or in a separate order form/agreement for that restaurant account. Unless otherwise agreed in writing, fees are non-refundable except where required by law.
6. Intellectual property
RestaurantMart retains all rights in the Service, its software, and branding. Restaurants retain ownership of their own menu content, images, and branding uploaded to the Service, and grant us a license to host and display that content as needed to operate the Service for that restaurant.
7. Third-party services
The Service may include advertisements or integrate with third-party providers (for example, hosting or push-notification services). We are not responsible for the content or practices of third parties beyond our reasonable control.
8. Disclaimers & limitation of liability
The Service is provided “as is” without warranties of any kind, express or implied, to the fullest extent permitted by law. To the fullest extent permitted by law, RestaurantMart is not liable for indirect, incidental, or consequential damages arising from use of the Service, including losses arising from order errors, downtime, or data loss.
9. Termination
Either party may stop using or providing the Service at any time, subject to any minimum term in a separate agreement. We may suspend access immediately for a material breach of these Terms.
10. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless a separate written agreement with your restaurant specifies otherwise.
11. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.
